We would like your feedback on our draft Park Lands Lease and Licence Policy. This Policy, if adopted, will supersede the Adelaide Park Lands Lease and Licence Policy and Operating Guideline adopted by Council in January 2016.

What is the history of this policy?

In January 2016, Council adopted an Adelaide Park Lands Lease and Licence Policy and Operating Guideline. The Policy and Guideline were developed to guide lease and licence negotiations consistent with the Adelaide Park Lands Management Strategy.

The Adelaide Park Lands Management Strategy and Community Land Management Plan provide the overall guidance on what can occur in the Adelaide Park Lands and where. The Park Lands Lease and Licence Policy informs the process for how we will grant a lease or licence in the Park Lands. 

Why are we consulting on a draft Park Lands Lease and Licence Policy? 

The Kadaltilla/Park Lands Authority identified the review of leasing and licensing policies as a priority in its Strategic Plan. We undertook a review of the 2016 policy and researched best practices relating to leasing and licensing of community land under the care and control of local government in Australia. During the review a number of changes were proposed. You can view the proposed changes to the 2016 Policy here. 

The outcome of the review process was the production of a draft Park Lands Lease and Licence Policy (which incorporates the proposed changes ) that was approved by Council on 10 May 2022 for the purpose of community consultation.

Permitted Activities

The Draft Policy describes activities permitted under a commercial or community lease or licence (see page 1).

Tenure

The Draft Policy recommends a standard tenure period of five years, with up to 21 years considered where a significant capital contribution is proposed (see page 1).

Selection of a Lessee/Licensee

The Draft Policy recommends that a lessee or licensee be selected through an Expression of Interest (EOI) process. The Draft Policy also details exceptions to the EOI process (see page 2)

Commercial Lease and Licence Fees

The Draft Policy recommends that commercial lease and licence fees will be informed by an independent market assessment and reviewed periodically (see page 3).

Community Lease and Licence Fees

The Draft Policy recommends that community fees be adopted annually as part of Council’s fees and charges and based on the area occupied (at ground level). The Draft Policy recommends that a discount on community fees of up to 75% be considered based on the following objectives: sound governance, environmental sustainability, social inclusion and optimal utilisation (see page 3).

Sub-letting and Casual Hire

The Draft Policy details a number of sub-letting and casual hire conditions including fees being set by Council, a requirement to make facilities available, seeking approval for commercial activities, and sub-letting agreements not exceeding five years (see page 4).
